Relationship advice columnist Ann Landers once wrote, “Every marriage is happy. Its the living together afterward that’s the challenge.”

Ann is right. Whatever else marriage may be, it’s a gamble. It’s also contract. So it has become increasingly common for people to enter into the bond of marriage with the caution formerly reserved for big business mergers.

The Eyes of the Beholder
From a religious perspective, marriage is a “holy union.” From the state’s perspective, marriage is a voluntary private agreement by a man and a woman to become husband and wife. And in the eyes of the judicial system, marriage is a binding contract with specific obligations under the law. And one day, that contract may need to be dissolved.

That’s why prenups were created.

Marriage is an emotional and physical union, but it’s also a financial union. A prenuptial agreement looks beyond the clear-and-present joy of two people in love. Instead of being ‘caught up in the moment,’ a prenup makes provisions for life’s unexpected twists and turns. It’s an important ‘insurance policy’ that protects both parties from an unknown future.

What Is A Prenuptial Agreement (Pre-Marital Agreement)?
In essence, a prenuptial agreement is a legal document – a contract between the bride and groom – made before they wed. In most cases, it details what will happen to their individual and collective incomes and assets if a death, divorce, or separation occurs.

A prenup is not a ‘test’ of love. It should not be seen as ‘the easy way out’ for people who aren’t sure their marriage will last. Instead, a prenup may be looked upon as a security net, a safe place to fall just in case you do.

What Is Its Legal Validity
Until recently, it was not uncommon for prenuptial agreements to be overturned by the courts. Many were struck down for their unreasonable terms or gross inequality. But in a landmark case decided in March 2004, the Supreme Court of Canada upheld a duly executed marriage contract, despite the fact that the terms were unfair.

The court declared that while the terms of might questionable, the drafting of the agreement had met the legal requirements for a valid contract. This is a strong indicactor that the courts are reluctant to interfere in voluntary contracts made by two well-educated adults with legal representation.

Despite the move towards upholding prenups, however, there remain unimpeachable reasons why a prenup may be invalidated.

As a contract, a prenup may be invalidated for the same reason as any contract. Which is to say that it was entered into under duress, because of undue influence, fraud, unconscionability, fundamental breach, by mistake, and so on.

Grounds for invalidation also include failure by a spouse to disclose fully his/her assets and debts at the time of signing. And finally, the agreement may also be thrown out if one spouse did not understand fully the nature and consequences of the prenup.

I’m A Second-Story Man

Can you say who you are and what you do in two
sentences or less?

If someone should ask (in an elevator, get it?)
what do you do? You should be able to recite the
answer as fast as Robin Williams comes up with a
quick one liner.

Robin Williams can do it because he has rehearsed
every line. He is just waiting for the opportunity
to bring up another fully rehearsed blurb. There
is no “ad-lib” from Robin, he has carefully worked
out every retort to be very funny.

Your elevator speech should be delivered
completely rehearsed, no thinking to it, when you
get the question: “What do you do?”..

We’re not talking labels here, or vague references.

“I’m in Hardware”
“I’m a Plumber”
“I sell life insurance and used cars”.
“I’m a consultant “
“My company sells printing presses”
Or the worst of all “I’m in sales”

They all say what you do, but what they say is all
about you. It should be all about them. It should
describe how you add value. It should describe the
benefits. Most of all, it should stimulate
conversation!!!

Your well-rehearsed elevator speech should, in two
sentences or less, explain what you do (benefits)
not what you are (title). Every person in business
should have an Elevator Speech. Your elevator
speech should encourage conversation and get them
thinking.

When you say what you do, what you say should get
the response “Oh? Tell me more..”
Even if you are talking to a person you KNOW will
NEVER be a customer, do it anyway. That person may
know someone who COULD be a customer. You can’t
tell, so treat them all as prospects and give it
your best shot.

Think about what you do and the benefits you
provide customers, or think about what you sell
and the benefits. Remember, every business
situation the customer wants to know, “What’s In
It For Me?”.

With a little practice you can make your elevator
speech so compelling they have to ask. Answering
the “What do you Do?” question with “I
sell the best extension ladders made in America!”
might get a yawn in response. But give it a little
twist and you have a winner.

“I’m a second story man and my ladder hasn’t let
me down yet!”

“Oh? Tell me more”

“My extension ladders help people get off the
ground safely to do jobs as much as 45 feet in the
air. Our ladders have extra wide steps on every
other tread. Do you use ladders in your business?”

POW! Business connection made.

As easily as you can respond to “What’s your
name?”, you should be able to recite your elevator
speech, and be able to follow up with several
clarifying sentences. After that salesmanship
takes over and off you go.

Craft your Elevator Speech so the other person
can’t say:

“That’s nice, but I’m not interested”

“We already have one of those”

Think benefits. Work to get the “Oh? Tell me more”
response. And do it in two sentences or less.

With so many comparison shopping search engines, you no longer have an excuse to buy software full price. These simple pointers will show you how to get 10-50% off practically any software or game.

Tip One – compare the price comparison engines.

The top three price comparison engines are Froogle (by Google), Yahoo!Shopping (shopping.yahoo.com) and PriceGrabber. Froogle is the most comprehensive of the three because it does not charge merchants for their listings. The benefit of that is a a very large inventory of listings. However, sometimes this results in obscuring results. For instance, if you enter “Luxor Game” in order to search for a popular casual downloadable game by MumboJumbo, the first six listings will be totally unrelated to the product searched for. On the other hand, Froogle does usually find the best deal for software or games and posts it on the very first page, so all you have to do is to weed out irrelevant results. In this particular case, Froogle was able to find a merchant selling Luxor for $17.99

Yahoo!Shopping, on the other hand, provides more relevant results, with a proper match for “Luxor Game” in the very first position. However, Yahoo!Shopping only list products sold through Yahoo!Shops, therefore the inventory is much smaller, which decreases a chance of finding the lowest price. In this case, the best price for Luxor is $18.88, well above Froogle’s.

PriceGrabber works as a paid inclusion service, which means that its inventory of listings is smallest of the three comparison engines. However, because some large software merchants use this service, occasionally, PriceGrabber offers a rare chance fo find a really great deal. In case with “Luxor Game”, PriceGrabber matched Yahoo! at $18.88, which is still below Froogle’s results.

Tip Two – search only for downloadable versions.

Even though you may find very good prices through Froogle, Yahoo!Shopping or PriceGrabber, a vast majority of the merchants sell boxed versions of software that need to be shipped. These shipping charges often increase the price of software by three to five dollars, which is quite significant for software that may cost only twenty dollars or less. Solution? Buy downloadables version.

The two best places to go for downloadable software are Download.Com (a CNET site) and Deprice.Com. CNET’s Download.Com is not a price comparison search engine. However, it lists over 50000 software and game titles that can be downloaded and bought online. The prices are listed right below the date software was added.

Deprice.Com is a specialized website that list only discounted and only downloadable software. It’s searchable database contains only 14000 listings, which is not large enough to cover all popular software, but is still worth the search.

Building a Strong Business Relationship

When it comes to business and sales, building a strong relationship is critical. The stronger your relationship is with your customer, the more likely they will be to refer you business.

Every day, make an attempt to build on the relationships you have with your customer. Don’t just say hi as they walk in and goodbye as they leave.

The last thing you want to do is make your customer feel like a statistic.

Let them know that their business with you is appreciated. Talk to them, strike up a non-business conversation with them. It could involve just about anything, such as the weather, sports, a movie, pets, etc.

Non-business conversation puts your customer at ease and gets them talking. The more they talk to you, the more they will open up to you, opening the door for more sales opportunities.

Or, you can keep it simple. For starters, get to know you customers by name, than address them by name. Say things such as, “how’s it going today?” Or “how was your weekend?” Or “is there anything I can help you with today?” Make your presence known and felt.

Your customer wants to be appreciated, so take a few minutes of your time to show them that you care about them as a customer.

Another way to strengthen your relationship with your customer is to keep a Rolodex handy with a list of all of your customers birthday’s, anniversaries, and special events. Keep your eyes and ears open for when customers talk about up coming events in their lives. Such as children’s birthdays and graduations.

When the appropriate date approaches, send your customer a card, wether it is a holiday card, a birthday card, a graduation card, or a congratulatory card. Just send it.

Your customers will appreciate the fact that you remembered them on their special day. This will only strengthen the relationship you already have with them.

There are many reasons to build a strong relationship with your customer, but two of the reasons remain to be key.

One main reason is that customers value and appreciate good customer service. They want the piece of mind of knowing that if something ever happened with their product or service, that they would have you to turn to as their go to person.

This is extremely important because your customer will have this in mind when your competition moves in to take them away.

And believe me, your competition will try to take them away. As long as you provide excellent customer service, your customer will stick with you.

There is no substitute for excellent customer service.

Customer service is the most important thing to a customer, even more important than fees’.

The second reason building relationships are so important is because of the referral process.

A customer that is treated with respect and provided excellent customer service will most assuredly refer their family and friends to you. Why wouldn’t they?

Your most important asset is your customer, so build and strengthen the foundations you have with them. Buy building strong relationships, you will be building your sales. Good luck.

Good Forward Planning Essential for Repaying Debts

Responding to a new report from PricewaterhouseCoopers suggesting that over a quarter of borrowers are worried about their ability to repay debts, debt management company Gregory Pennington has advised consumers that all forms of borrowing should be planned well to ensure that the debts can be repaid, and has encouraged anyone struggling to repay their debts to seek professional debt advice.

The Credit Confidence Survey by PricewaterhouseCoopers suggested that over one in four people (27%) are worried about their future ability to repay debts, while 20% of UK credit customers are worried about the future availability of credit – suggesting a reliance on credit to pay off existing debts.

16% of those questioned reported that they were already struggling to make debt repayments, “very few” of whom have considered options to restructure their debt, such as a debt management plan.

The report also found:

  • Unsecured borrowing has actually risen by 6% compared with last year – although secured borrowing has fallen ‘dramatically’
  • Insolvencies increased by around 9% in the third quarter of 2008, compared with the second quarter
  • Every working hour, over 100 adults enter into bankruptcy, an Individual Voluntary Arrangement (IVA) or start a Debt Management Plan

A spokesperson for Gregory Pennington commented: “Although the survey on the whole represents good confidence levels amongst a lot of borrowers, the fact that over one in four borrowers are worried about their future ability to repay debts highlights the importance of future planning when it comes to borrowing.

Building Relationships

Don’t you get a little weary listening to all the experts trumpeting, then droning on-and-on that ‘it’s all about relationships.’ It troubles me since no one has taken time to analyze what it takes in developing quality long-term relationships. It’s important because all of us count on our referral network in one way or another as a lead source. And as we know, getting a referral is the surest way to a new customer.

Ask yourself, has anyone bothered helping you understand what it takes to build and maintain a quality relationship?

Consider building quality relationships as a PROCESS. Yes, think of it as a step-by-step sequence that takes time and patience with a long-term goal in mind because we never know where the next referral will come from. If you think you can do it in one or two ‘touches’ you are totally delusional! It takes continuous positive experiences over time.

1st Stage – Acquaintance

When we meet someone for the first time we want to be friendly, cordial and above all genuine. Nobody likes a phony. People today have a natural resistance to accepting anyone into their ‘circle of friends’ as Robert De Nero said in the movie “Meet the Fokkers.” A little kindness and spirit of friendliness never hurt any budding acquaintance. Certainly asking non-threatening questions is a great way to break the ice and serves as a starting point. Taking a real and sincere interest in the acquaintance’s answers shows you are listening, paying attention to what they are saying and forms a position from which any subsequent dialogues, ‘touches’ and contacts can be initiated. And it helps if you remember some defining comment the acquaintance made to you which demonstrates you found something significant and impressive about them in the initial conversation.

2nd Stage – Connection

There is somewhat of a quantum leap from acquaintance to connection. It requires us to be easy to communicate with and understand. At this Stage something almost surreal happens when a bond and a commonality gets identified between both parties. This could be something as simple as growing up in the same city, having a common friend or having worked in the same company in the past. At this Stage both parties realize they are no longer total strangers to each other, rather they have one or many things in common.

Step 3 – Mutuality of Purpose

Do we have a common goal in mind, namely do we share the values providing quality service, being responsive and recognized as a reputable salesperson. Is there a ‘meeting of the minds’ as it were in how we conduct ourselves and our business affairs – specifically with honesty and integrity. Do we have the same objectives, such as resolving an issue or eliminating a problem. Is there a way either we or they can help another customer or friend. In my experience acquaintances and connections do not advance to this stage because they have not let each other know how they can help each other. In selling we call this relationship-focused purposefulness.

Be mindful I’m not talking about winning a popularity contest. It was Abe Lincoln who said, “You can’t please all the people all the time.” However one thing you can do which influences potential relationships and referrals is to be a pleasant, polite and professional individual.

4th Stage – Relationship

What determines if our acquaintances, connections and mutually purposeful contacts will ever mature to a relationship is based on trust. However, much more significantly, we will advance to this stage when we have demonstrated long standing competence and achieved a level of respect that only gets established when we act and perform in a consistent manner. Consistency is the touchstone leading people to feel comfortable around us. And one of the ways they feel at ease is knowing we will be the same as last time – friendly, respectful and trustworthy. Could you count on them if a situation or opportunity arose requiring their experience, background or assistance? Those wise in the relationship building process know that a little trial or test in one area is at least an indicator of what that person would be like in a more complex situation. Frankly, if we live up to our word and conclusively show we know what we’re talking about and what we are doing, we have reached that Stage called relationship.

5th Stage – Maintenance

Let’s not take our relationships for granted nor ever forget we are only as good as our last sale. A relationship can be compromised when we muff an opportunity that has been referred to us. And when it does the prior relationship may be in serious jeopardy. If we do a less than a quality job that word gets back to our referral source, then they may begin to doubt our competency and possibly no longer have a positive impression of us. They may eventually disregard us down stream as a viable supplier of goods and services.

Conclusion

After more than thirty years of building relationships I have come to the conclusion that the PROCESS is incredibly similar to what excellent sales people do. And just in case you think you are not in sales, be mindful of what Robert Louis Stevenson once noted, “Everyone makes a living by selling something.”

It is fascinating to me that Americans are an impatient lot. The Point? I believe it is virtually impossible to jump from Stage 1 – Acquaintance to Stage 5 – Maintenance in a single contact event. It takes time and patience to build a relationship. It can’t be done in one ‘touch’. While it may take many interactions, nonetheless it can be accomplished in fewer ‘touches’ when the first three Stages occur in a short time span.

Now you know why I call it “building a relationship”. It’s like building a house; you can’t put the roof on until the concrete pad is down and the walls are up. It requires us to be trustworthy, honest, credible and competent. And don’t fool yourself, the test of these goes through a gestation and maturation cycle during each of the Stages.

So if you are intent on building quality relationships, and in selling it is vital we do, then appreciate where you are in the Stages mentioned above with everyone with whom you are attempting to cultivate a relationship. Trying to move the PROCESS too quickly will probably cause indigestion from too much too fast. Give it time and let the Stages play out; in so doing both parties will have a much clearer sense of each other and how each can become a trusted referral source to the other. Above all abiding by the above PROCESS will assist in getting us to our goal of quality long-term relationships.

Panic attacks and anxiety attacks can affect you in many different ways. Have you ever hit snooze on your alarm in the morning and almost physically not been able to get out of bed? Have you had an overwhelming dread about going to work, and felt as if you just couldn’t “go through the motions” one more day?
